- A federal judge ruled that HHS took “arbitrary and capricious” action when it warned Eli Lilly & Co. and other drugmakers that they’d violate the law by ending mandated discounts to health care providers serving low-income patients through the 340B drug discount program. The judge also criticized Eli Lilly for “unilaterally” eliminating discounts in a way that hurt the program, but took no steps to restore them. (Article here)
