  • Senators Maria Cantwell and Chuck Grassley introduced legislation that would prohibit certain pharmacy benefit managers (PBMs) from engaging in unfair pricing tactics such as “spread pricing” or deceptive claw back payments made to pharmacies. The “Pharmacy Benefit Manager Transparency Act of 2022” also includes measures to encourage fair and transparent PBM practices, such as requiring PBMs to file an annual report with the Federal Trade Commission (FTC). The legislation comes three months after the FTC deadlocked on a motion to study how PBMs influence drug prices and the pharmacy business. (Press release here; Article here)
